The customer agrees that the use of this website for the booking of any travel shall limit the jurisdiction of the filing of any lawsuit or legal action whatsoever by customer to the courts of Solano County, CA. The applicable law shall be that of the State of CA, County of Solano, or applicable Federal Law of the United States of America. Mom Loves Travel reserves the right to change the terms, conditions and any other notices under which this website is offered and you agree and be bound by those terms, conditions, and notices that are in effect at the time of your use of this website and associated facilities.
These terms and conditions (“Terms and Conditions”) govern the relationship between _Moms Love Travel Agency (“MLTA” and/or “we/us/our”) and you, the purchaser and/or traveler (“Client” and “passenger” and “you/your”). By planning travel with MLTA, you agree to be bound by these terms and acknowledge that MLTA acts solely as a booking agent for disclosed principal supplier tour operators, cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and other services (“Supplier(s)”) and is not the source or provider of the travel services. These terms include warranties and disclaimers and exclusions of liability and may restrict your rights and remedies and provide protection to MLTA.
1. USE OF MLTA SERVICES, ACCESS AND INFORMATION FOR TRAVEL BOOKINGS
You warrant that you are at least 18 years of age and possess the legal authority to enter into this Agreement and to make travel bookings with MLTA. You agree to be financially responsible for all of your travel bookings made on behalf of yourself and any member of your traveling party and warrant that all information supplied by you on behalf of yourself, members of your household, or others for whom you are authorized to transact business with us is true and accurate. You agree that you will only make legitimate reservations or purchases with MLTA and its Suppliers, and acknowledge that, without limitation, any speculative, false, or fraudulent reservation is prohibited.
All bookings are accepted by MLTA as agent for the travel Suppliers on your itinerary. Separate Supplier terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select, and you understand and agree to abide by the terms and conditions of purchase imposed by any Supplier that you have selected as a service provider on an itinerary you have approved.
MLTA is registered with California Seller of Travel 2128039-70. Registration as a seller of travel does not constitute approval by the State of California.
2. PAYMENTS AND CANCELLATIONS
You shall be completely responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings through MLTA. By submitting a credit card authorization form to MLTA, you agree to allow MLTA to use your payment method to purchase travel products from our Suppliers on your behalf. EXCEPTING IN CASES OF FRAUD, YOU AGREE NOT TO FILE ANY DISPUTE WITH YOUR BANK OR CREDIT CARD COMPANY TO AVOID OR VIOLATE ANY BOOKING TERMS AND CONDITIONS OF MLTA OR ITS SUPPLIERS, INCLUDING CANCELLATIONS OR CHANGES OF ITINERARY OR ARRANGEMENTS FOR REASONS BEYOND THE CONTROL OF MLTA OR ITS SUPPLIERS. IF YOU ATTEMPT TO CHARGEBACK, REVERSE OR RECOLLECT A PREVIOUSLY AUTHORIZED TRIP PAYMENT, MLTA RESERVES THE RIGHT TO COLLECT ALL ADDITIONAL COSTS, FEES AND EXPENSES ASSOCIATED WITH SUCH CHARGEBACK, REVERSAL OR RECOLLECTION, INCLUDING, WITHOUT LIMITATION, ATTORNEY FEES.
All payments for travel are due prior to departure according to each Supplier’s terms and conditions of booking. You understand that failure to make final payment or any violation of a Supplier’s conditions of purchase may result in cancellation of your reservations, in your being denied access to any flights, tours, hotels, cruises, or other travel services, or in your forfeiting any monies paid for your reservations. In some cases, there is NO REFUND once a booking is made and under deposit. You may not be entitled to a refund if you change or cancel your travel plans after confirmation of a booking. All cancellation requests must be sent to MLTA in writing. As a result of cancellation, MLTA's and third-party Supplier’s cancellation penalties will apply. Cancellation fees will be charged to the credit card or other payment method you authorized to pay for travel services or deducted from the Supplier’s refund.
3. TRAVEL DOCUMENTS, INCLUDING TSA AND DHS ACCEPTABLE IDENTIFICATION REQUIREMENTS
It is the responsibility of each Client to obtain and carry a valid passport, visa(s), and all other documents required by applicable government regulations. When traveling domestically or internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry acceptable identification in order to board a flight. Acceptable identification can be found at http://www.tsa.gov/traveler-information/acceptable-ids; examples are DHS-designated enhanced driver’s license, Passport, a foreign government passport. The name, date of birth and gender that appears on the identification card must exactly match the same such data that is listed on airline ticket(s) and booking records. You acknowledge any failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing Client to miss flight(s), and subsequent scheduled travel bookings on cruises and tours.
WHEN YOU RECEIVE ANY AND ALL TRAVEL DOCUMENTS, IT IS YOUR RESPONSIBILITY TO REVIEW AND VERIFY ALL INFORMATION FOR ACCURACY. CONTACT MLTA IMMEDIATELY IF CHANGES OR CORRECTIONS ARE REQUIRED.
MLTA strongly recommends that you take into account that certain countries will not admit a passenger if their passport expires within six (6) months of the anticipated date of return. Non-United States citizens may require additional documentation. Client is responsible to make MLTA aware when traveling on a passport from a country other than the United States of America. MLTA neither controls nor warrants the issuance of visas or approval of visa waivers related to your travel. Should a visa not be issued, MLTA is not responsible for lost payments made toward the contemplated trip. Please note that rules of each country regarding entry and exit change on a daily basis.
Children and infants also require travel documents. Minors traveling with one parent, and/or without both parents, may be stopped and not admitted, unless authenticated and verified consent forms are provided to the authorities; please see https://help.cbp.gov/s/article/Article-3643 for additional information.
4. INDIVIDUAL ENTRY AND EXIT REQUIREMENTS
Each country holds different views of past criminal offenses, whether within or outside of their boundaries. If you have a current or prior criminal offense, contact that country directly for entry and exit requirements. You can visit the US State Department Website for further information about these requirements. See, https://travel.state.gov/content/travel.html. We do not inquire about an individual’s criminal record in the interest of respecting our clients’ privacy. For example, if traveling to or through Canada, individuals with a Driving While Intoxicated (DWI) record should review current entry requirements. See: https://www.canada.ca/en/immigration-refugees-citizenship/services/immigrate-canada/inadmissibility.html.
5. HAZARDOUS MATERIALS
Federal law prohibits passengers from bringing hazardous materials on the aircraft.
(1) Federal law forbids the carriage of hazardous materials aboard aircraft in the passenger’s luggage or on the passenger’s person. A violation can result in five years’ imprisonment and penalties of $250,000 or more (49 U.S.C. 5124). Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives and radio- active materials. Examples: Paints, lighter fluid, fireworks, tear gases, oxygen bottles, and radiopharmaceuticals.
(2) There are special exceptions for small quantities (up to 70 ounces total) of medicinal and toilet articles carried in the passenger’s luggage and certain smoking materials carried on the passenger’s person. For further information, each passenger should contact the relevant airline representative(s) on their itinerary. Restrictions on hazardous materials are listed http://www.tsa.gov/traveler-information/prohibited-items.
6. INSECTICIDE NOTICE
We recommend that you refer to the DOT list of airports in countries that require airlines to treat the passenger cabin with insecticides prior to the flight or while on the aircraft. This list is on the DOT’s website and is updated from time to time: http://www.dot.gov/office-policy/aviation-policy/aircraft-disinsection-requirements.
7. HEALTH/IMMUNIZATIONS
You must have the proper immunizations and health screenings and required documentation of such immunizations and screenings before travel. MLTA shall not assume responsibility for the accuracy of health, vaccination, or documentation prior to departure or upon landing at the final destination. In some cases, required inoculations must be recorded by Client’s health practitioner on a valid vaccination certificate, which the Client must carry for proof of inoculation. If you are concerned about taking any medications or receiving certain inoculations, check with your health practitioner BEFORE booking. Check the State Department Web site http://travel.state.gov, for relevant information relating to travel to specific destinations, and the Center for Disease Control http://wwwnc.cdc.gov/travel/ relating to health issues related to travel.
8. ACCESSIBILITY, TRAVELERS WITH DISABILITIES, SPECIAL TRAVEL NEEDS.
Travelers with disabilities or special needs who may require non-emergency special services, additional support or accommodation of a disability should advise us in advance of booking, so that we can request assistance or arrange for appropriate services or equipment. In some cases when travelers are unable to use their own wheelchairs, mobility devices, medical equipment or devices, rental of special equipment or devices may result in additional charges. Airlines may impose charges for additional baggage and may have restrictions on the size of wheelchairs that they can accommodate.
In order to travel with a service animal or emotional support animal, some Suppliers may require advance arrangements and special documentation of the animal’s health and training.
When traveling outside of the United States or Canada, laws and regulations applying to people with disabilities will often apply different standards of accommodation for travelers with disabilities or special needs. While we are committed to assisting travelers with disabilities or special needs, MLTA is not responsible for the failure of Suppliers in those countries to meet the needs of travelers when the Supplier follows laws and regulations of the local jurisdiction. Additionally, the laws and regulations of local jurisdications covering travelers with disabilities or special needs may change without prior advance notice and MLTA bears no responsibility in case of changes in the legal or regulatory framework of the places you may visit on your trip.
Certain destinations may have limited medical facilities or limited availability of prescription medications. We recommend that you consult with your health practitioner to discuss the details of your trip. Certain travel insurance plans may provide access to emergency medical care, medical evacuation and replacement of prescription medication. WE RECOMMEND THE PURCHASE OF COMPREHENSIVE TRAVEL INSURANCE ON ALL BOOKINGS.
9. AIR TRAVEL, SCHEDULE RECONFIRMATION, CHECK-IN
Your airline ticket is a contract between you and the air carrier, even if you purchase through MLTA, you acknowledge and agree that MLTA is not liable for any personal injury, property damage related to your purchase of air tickets or air travel, including, but not limited to any act, error, omission, injury, loss, accident, or delay caused by any act, error or omission of the airline, including their failure to deliver services, partial or inadequate delivery of services, airline policies including refund or rebooking policies, fees for checked or carry-on luggage, fuel increases, bankruptcy or cessation of operations.
You understand and agree that MLTA functions solely and exclusively as a booking agent for the air carrier, that we do not handle or hold client funds for airline tickets, and that we are not the Merchant of Record under the meaning of that term under the Department of Transportation's regulations. Because MLTA does not hold or handle client funds, you understand and agree that any refund for cancelled or delayed flights, baggage fees or seat assignments must come directly from the airline and not from MLTA.
MLTA shall not assume any responsibility for any air schedule changes. In rare instances, upon departure from a country, certain departure taxes must be paid in cash only, and may vary in price. Failure to use a reservation may result in automatic cancellation of all continuing and return flights, as well as forfeiture of airfares. Airline e-tickets expire a year from issue date unless carrier fare rules in passenger’s itinerary fare provide otherwise. Due to enhanced security, it is strongly recommended that you check in a minimum of 2 hours prior to scheduled departure for domestic flights and 3 hours prior to scheduled departure time for international flights. Reconfirm flight times at least 24 hours prior to scheduled departure time for domestic flights, and 72 hours prior for international flights.
Frequent Flyer mileage accrual is at the discretion of the airline(s). MLTA has no liability if accrual of miles or points is denied or if upgrades are not allowed. Many airlines do not permit upgrades on airfare purchased in certain fare classes or when using frequent flyer miles, loyalty status or certificates.
Seat assignments are not guaranteed even after they are assigned, and MLTA has no control over airline seat assignments. Most airlines charge a fee to pre book a seat.
10. RIGHT TO CORRECT ERRORS/OFFERS SUBJECT TO AVAILABILITY
We reserve the right to correct errors. In the event of any pricing error or omission, we reserve the right to adjust such pricing or make any other corrections. All offers, incentives and Supplier promotions are subject to availability and may change without notice. Prospective Clients are advised to reserve early to avoid disappointment, increases in fares and additional late booking fees.
11. UNUSED ARRANGEMENTS, MINIMUM PASSENGER REQUIREMENTS AND ALTERATIONS TO BOOKINGS
When tour, cruise or package prices are based on Suppliers’ contract rates, you will not be entitled to any refund for any unused portion of travel.
Some group tours are based on minimum numbers of passengers traveling; if the number of passengers falls below the minimum required, a surcharge may be imposed, or the tour may be canceled. Any cancellations of a tour or package for reason of failing to meet the minimum traveler requirement will be governed by the tour operator’s cancellation policy.
If you decide to change any portion of your confirmed arrangements prior to departure or during your trip, we will attempt to assist you. Certain bookings may not be able to be changed. All requests for changes to a booking must be made in writing to MLTA.
The Supplier may determine that alterations in itinerary are necessary for any number of reasons, including but not limited to severe weather. Any alterations to an itinerary are at the sole discretion of the Supplier, and MLTA bears no responsibility for any changes.
12. LIMITATIONS OF RESPONSIBILITY AND DISCLOSURE
MLTA acts solely as a booking agent for disclosed principal Suppliers and is not the source or provider of any travel service. Each Supplier is an independent entity with its own management and is not subject to the control of MLTA. The Suppliers whose names appear in travel documentation are those actually responsible for providing the travel services purchased, and you consent to the use of those Suppliers.
BECAUSE MLTA ACTS AS AGENT FOR DISCLOSED PRINCIPAL SUPPLIERS AND DOES NOT HAVE THE RIGHT TO CONTROL THE OPERATIONS OF SUCH INDEPENDENT OPERATORS AND SUPPLIERS, YOU AGREE THAT MLTA IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE, WHICH MAY ARISE OUT OF THESE SERVICES. MLTA HEREBY DISCLAIMS ANY LIABILITY WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY DIRECT, PUNITIVE, SPECIAL CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES IN CONNECTION WITH THE GOODS OR SERVICES PROVIDED BY ANY PRINCIPAL SUPPLIER BOOKING THROUGH MLTA, INCLUDING WITHOUT LIMITATION LIABILITY FOR ANY ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY OR IRREGULARITY WHICH MAY BE INCURRED THROUGH THE FAULT, NEGLIGENCE, WILLFUL ACTS, OMISSIONS OR OTHERWISE OF SUCH SUPPLIER, OR OF ANY SUPPLIER OR THEIR RESPECTIVE EMPLOYEES, AGENTS, SERVANTS, OR REPRESENTATIVES, INCLUDING, WITHOUT LIMITATION, THEIR FAILURE TO DELIVER OR THEIR PARTIAL OR INADEQUATE DELIVERY OF SERVICES, THEIR CANCELLATION AND REFUND POLICIES, FUEL INCREASES, BANKRUPTCY, OR CESSATION OF OPERATIONS AND OTHER MATTERS OUTSIDE OF MLTA’S CONTROL, AND YOU HEREBY EXONERATE MLTA FROM ANY LIABILITY WITH RESPECT TO THE SAME.
MLTA HAS SOLELY RECEIVED COMMISSION AND FEES FOR TRAVEL TRANSACTIONS AND CLIENT AGREES AND UNDERSTANDS THAT ANY RECOVERY FROM MLTA WILL BE LIMITED TO THE AMOUNT OF COMMISSION AND FEES ACTUALLY RECEIVED BY MLTA.
We may book wellness travel for clients, which may include yoga, meditation, medi-spa, and other activities, treatments and services intended to maintain, manage, or improve travelers’ health and well-being (“Activity” or “Activities”). We have no specialized knowledge of the practices or techniques employed by our Suppliers and make no representations of the qualifications of the professionals and practitioners who offer these Activities. We make no representations that by participating in these Activities there will be any demonstrable improvement in your physical, mental, emotional, or spiritual well-being. We are not responsible if your participation in these activities leads to a worsening of any condition you may have. We are not responsible for any injuries you may sustain, illnesses you may contract, including injuries or illnesses that may result in loss of life. You acknowledge that you are voluntarily participating in the Activities on your itinerary, and that you understand that there are risks associated with your participation in the Activities, such as physical and/or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability, death or economic loss. These injuries or outcomes may arise from your own or other’s actions, inactions, or negligence, or the condition of the Activity location(s) or facility(ies). Nonetheless, you assume all risks of your participation in the Activity, whether known or unknown to you, including travel to and from the Activity (including air travel) or any events incidental to the Activity.
13. RISKS/SAFETY
Travel to certain destinations may involve greater risk than others. MLTA urges Clients to remain informed on a daily basis as to current news events, as well as to review travel prohibitions, warnings, announcements and advisories issued by the United States Government prior to booking travel to international destinations. Information on health and safety conditions in various countries and the level of risk associated with travel to particular international destinations can be found at http://www.state.gov, http://www.tsa.gov, http://www.dot.gov, http://www.faa.gov, http://www.cdc.gov, and http://www.cbp.gov. The Smart Traveler Enrollment Program (STEP) is a free service provided by the U.S. Government to U.S. citizens who are traveling to, or living in, a foreign country. STEP allows you to enter information about your upcoming trip abroad so that the Department of State can better assist you in an emergency. Registration is recommended and provided by going to https://step.state.gov/step/.
BY OFFERING FOR SALE TRAVEL TO PARTICULAR DESTINATIONS, MLTA DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO SUCH POINTS IS ADVISABLE OR WITHOUT RISK, AND SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS. CLIENT’S PARTICIPATION CONSTITUTES ACCEPTANCE OF SUCH EVENTS AT CLIENT’S OWN RISK.
In the event of emergent health or safety concerns, once MLTA has investigated the prevailing situation, MLTA shall have the sole and absolute discretion whether to proceed with any MLTA escorted trip or private departure, or to make alterations to the itinerary.
14. FORCE MAJEURE
MLTA will not be in breach of these terms and conditions or otherwise be liable to you, for any failure or delay in performing an obligation under this Agreement that is due to any of the following causes, to the extent beyond its reasonable control: acts of God, accident, riots, war, terrorist act, epidemic, pandemic, quarantine, civil commotion, breakdown of communication facilities, including web host and internet service provider, breakdown or malfunction of equipment, destruction of or serious damage to facilities, natural catastrophes including, but not limited to extreme weather events, floods and volcanic eruptions, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, generalized lack of availability of raw materials or energy, and any other unforeseen circumstance which is beyond the control of MLTA. THE PURCHASE OF TRAVEL INSURANCE IS HIGHLY RECOMMENDED ON ALL TRIPS.
In addition, each of MLTA’s Suppliers have terms and conditions which include Force Majeure provisions. In the event that a Force Majeure event occurs, those Suppliers may be entitled to, and may in their sole and absolute discretion, vary, postpone or cancel any itinerary or arrangement in relation to the trip. Payment of any refund to you as a result of the non-performance of any obligations hereunder shall remain in the sole and absolute discretion of the Supplier, pursuant to their policies, although MLTA shall use its reasonable efforts to secure reimbursement for you where possible.
15. CLIENT CONDUCT
Each participant in any trip escorted by MLTA is expected to act responsibly and adhere to all behavior guidelines established by MLTA and our Suppliers. MLTA and all local Suppliers reserve the right to remove you from any facility, hotel or resort property, tour location or means of transportation if your health or your conduct appears to endanger yourself or others, disrupts the general well-being of other clients on any element of your trip, or interferes with the operation or security of the places we visit. In any such case, there will be no refund.
When you book with MLTA, you accept responsibility for any damage or loss caused by you. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid directly at the time to the accommodation owner or manager or other Supplier. You must indemnify us for the full amount of any claim (also including legal costs) made against us. We are not responsible for any costs incurred concerning a guest removed from a trip, or any portion of a trip. You agree not to hold MLTA or any of its related entities liable for any actions taken under these terms and conditions. Baggage and personal effects are at all times the sole responsibility of the participant.
16. TRAVEL INSURANCE
MLTA OFFERS ACCESS TO TRAVEL INSURANCE TO PROTECT PASSENGERS AND THEIR INVESTMENT IN TRAVEL. UNLESS SPECIFICALLY NOTED, TRAVEL INSURANCE IS NOT INCLUDED IN THE COST OF CLIENT’S ITINERARY TO PROTECT AGAINST THIRD PARTY SUPPLIER DEFAULT/BANKRUPTCY PROTECTION, DELAY, INTERRUPTION, MISSED CONNECTION FOR CRUISES, CANCELLATION, MEDICAL EMERGENCY TRANSPORTATION/EVACUATION & REPATRIATION, BAGGAGE & PERSONAL EFFECTS/LOST LUGGAGE & BAGGAGE DELAY, ILLNESS, JOB LOSS PROTECTION AND CHANGE OF PLANS, ACCIDENTAL DEATH AND DISABILITY, TRAVEL ACCIDENT/SICKNESS MEDICAL EXPENSES, AND MORE. PROPER INSURANCE MAY PROTECT YOU FROM FINANCIAL LOSS IN ALMOST ALL CIRCUMSTANCES. Without appropriate travel insurance, Client understands and agrees that if Client cancels or interrupts Client’s travel for any reason, portions of the trip/tour may not be refunded and MLTA’s and travel Suppliers’ cancellation penalties will apply resulting in the loss of monies up to the full cost of Client’s travel booking and related costs. The purchase of travel insurance is not required in order to purchase any other product or service offered by MLTA, however if you decline to purchase insurance, MLTA will require that you execute an insurance waiver. MLTA is not a licensed insurance broker, and its advisors are not qualified or authorized to answer technical questions about benefits, exclusions, and conditions of any of the insurance offered, nor evaluate the adequacy of the prospective insured’s existing insurance coverage. An additional charge applies for any travel insurance selected. MLTA CANNOT GUARANTEE THAT ANY INSURANCE PROVIDER WILL APPROVE COVERAGE FOR A CLAIM MADE UNDER THE INSURER’S POLICY AND MAKES NO REPRESENTATIONS ABOUT THE EXTENT OF COVERAGE FOR ANY POLICY IT MAY OFFER OR QUOTE.
17. RESERVATION OF RIGHTS: CHANGES TO THESE TERMS
We reserve the right, in our sole discretion, to change these Terms and Conditions at any time. Updated versions of the Terms will be provided to Clients, will be posted on our website and are effective immediately on posting.
18. GENERAL
The laws of the State of California govern these Terms and Conditions. You hereby consent to the exclusive jurisdiction and venue of courts in Solano County, California in all disputes arising out of or relating to travel bookings with MLTA.
If any part of these Terms and Conditions is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and agreement shall continue in effect.
These Terms and Conditions (and any other terms and conditions referenced herein) constitute the entire agreement between the Client and MLTA with respect to travel bookings made with MLTA by any means, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between Client and MLTA with respect to communications with MLTA. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.

These Terms of Service state the terms and conditions of use of the services of Mom Loves Travel Agency (“Agency”), terms of travel and use of our website, momlovestravelagency.com (the “website”). Please read these terms before using our services and/or the website. Using our services, arranging travel through us and/or using our website is voluntary by you.
Acceptance of Terms
These terms address your obligations, restrict your rights and remedies and provide rights and protections to us with regard to use of our services, participating in travel arranged through us and of this website. The terms include warranty disclaimers and limitations and exclusions of liability. By visiting our website, or obtaining any service or product through us, you agree to be bound by these terms. You acknowledge and agree this is a fair balance because the website is available to you conveniently; and if you don’t agree or don’t want to accept these terms, you can easily choose to not visit the website. If you do not agree, or if anything is not in these terms that you consider essential, you can choose to not use our website. By using the website you agree to comply with all the Terms of Use.
About Us
We are Mom Loves Travel. (referred to as “we,” or “us” or “our”). Our address, which is a way to reach us as an alternative to using our website, is 319 Pepper Dr.,Vallejo, CA 94589.
Carrying Identification
You and each person in your group are responsible to obtain and carry a valid passport, visa and all other documents required by government(s) of the place(s) where you travel. The U.S. government advises everyone to carry at least two forms of acceptable identification in order to board a flight. The Transportation Security Administration (“TSA”) list of acceptable IDs is at www.tsa.gov/traveler-information/acceptable-ids. Name, date of birth and gender on the identification card must match exactly the same data on the airline ticket(s) and booking records.
Some countries refuse entry to a person whose passport expires within six (6) months of the date of attempted entry. A person who is not a U.S. citizen may need additional documentation.
Children and infants are not exempt. All such travel documents are required for children and infants. Children and infants traveling with one parent, or without both parents, may be denied entry, unless authenticated, verified consents are provided to authorities in the format and with content they require.
Any failure to comply with these requirements and each country’s particular or additional requirements may result in you, children or members in your group being denied boarding on a plane or other vessel, delay at security checkpoint or other travel gateway, missed flight(s), missed other transportation, missed travel bookings on cruises and tours and/or denial of entry into a country.

Entry and Exit Requirements.
Each country has rules and practices regarding past criminal offenses, whether within or outside the country. Criminal offenses may include, but are not limited to felonies, misdemeanors and seemingly petty offenses, also including driving under influence of alcohol or drugs. If you have a past or current offense, whether recent or a long time ago, please directly contact authorities in that country for entry and exit requirements, also including if you are only passing through. Some additional information may be at the U.S. State Department travel website.
Agency does not control issuance of visas. You are responsible to assure that: all visas required for your trip are obtained in advance; visas for each country are valid for your entry and exit dates; personal details are accurately reflected; and your passport is valid for at least six (6) months after completion date of your trip. Issuance of a visa does not assure entry. Local immigration officials make final entry decisions. You or members of your group may be denied entry despite having a visa.
Denial or delay of entry into or through a country for any reason, and/or a country’s non-issuance of a visa, is not grounds for a refund as to any aspect of your trip.
Out of respect for privacy and other considerations it is possible our staff may not ask you about your criminal history. It is your obligation to open discussion of this subject and share this information if you wish to do so. Particularly if the subject is not brought up by you, it is your obligation to be aware of restrictions on travel that may result from any past criminal matters.
Safety
Personal safety is a concern everywhere. No place, even home, is 100% safe. Some places have greater safety risks than others. You are responsible to become and stay informed about places where you will travel, by reading current news, reviewing travel prohibitions, warnings, announcements and advisories issued by the U.S. Government prior to and after booking travel. Information on conditions in various countries and levels of risk associated with travel to particular destinations can be found at websites of the U.S. State Department www.state.gov, TSA www.tsa.gov, Department of Transportation www.dot.gov, Federal Aviation Administration www.faa.gov, U.S. Centers for Disease Control www.cdc.gov, and U.S. Customs and Boarder Protection agency www.cbp.gov.
You should consider enrolling in the U.S. Government’s free Smart Traveler Enrollment Program (STEP). Government. STEP lets U.S. citizens and nationals traveling and living abroad enroll their trip with the nearest U.S. Embassy or Consulate. STEP lets you enter information about your upcoming trip so the State Department can provide information on safety conditions to help you make informed decisions about travel plans, help the U.S. Embassy contact you in an emergency and help family and friends contact you in an emergency. AGENCY’S OFFERING, ARRANGING OR ASSISTING IN ARRANGING TRAVEL TO PARTICULAR DESTINATIONS IS NOT A REPRESENTATION OR WARRANTY THAT TRAVEL TO THOSE PLACES IS ADVISABLE, SAFE, RISK FREE, OR OF TOLERABLE OR ACCEPTABLE RISK. AGENCY AND ITS PERSONNEL SHALL NOT BE LIABLE FOR COSTS, DAMAGES, OR LOSSES, ALSO INCLUDING PERSONAL INJURY, DELAY, CRIME, DEATH, INJURY TO OR LOSS OF PROPERTY, THAT MAY RESULT IN OR DURING OR AS RESULT OF TRAVEL TO ANY DESTINATION. YOU ASSUME AND ACCEPT, FOR YOURSELF AND YOUR GROUP, ALL SAFETY AND OTHER RISKS ASSOCIATED WITH YOUR TRAVEL.
Authority and Responsibility
You warrant that you are at least 18 years of age and have full legal authority to make travel bookings with Agency and agree to these terms. You agree to be financially responsible for all your travel bookings and use of your account by others, also including, without limitation, any minors using your account.
Communications
You agree to supervise all use of Agency communications by minors and others using your account. You warrant that all information supplied by you or members of your household transacting business with Agency is true and accurate.
Certain Reservations are Prohibited
You agree to make only legitimate travel reservations with and through Agency. You agree not to make or attempt to make any reservation with intent to cancel after benefitting from a promotion, any speculative, false, or fraudulent reservation or any reservation in anticipation of benefitting from demand, without intent to use the reserved travel.
Separate Terms
Separate supplier terms may apply to your reservation and purchase of travel-related services and merchandise you select. You agree to abide by the terms and conditions imposed by Agency and any supplier you elect to deal with, or with whom Agency deals on your behalf, including but not limited to, payment of all amounts when due and compliance with the supplier’s rules and restrictions on availability and use of fares, products, or services. Violation of a supplier’s terms may result in cancellation of reservation(s) or purchase, denial of access to flight, hotel, cruise, or automobile, forfeiting monies paid for reservation or purchase, charging your account for costs incurred due to a violation and other relief. You shall be responsible for all charges, fees, duties, taxes, and assessments arising out of your travel bookings through Agency.
Booking on Third Party Sites
You authorize Agency to book on third party sites to aid in fulfilling your travel requests. You ratify Agency’s actions on your behalf, including acceptance of third party terms that limit your rights, and you agree to bound by such actions. In an inconsistency, conflict or ambiguity of terms, Agency shall have the right to benefit from the interpretation, construction and choice of terms that are most favorable to Agency in each instance.
Payment and Cancellation
Final payment is due the length of time prior to departure set by terms of each supplier involved in your booking or tour (airline, hotel, cruise line, transfer company, sightseeing operators and other travel service providers). If full payment is not received by the due date, your reservation may be cancelled without additional notice and deposits will be forfeited. Some supplier terms specify that there is no refund after a booking is made and paid for. Your ability to obtain a refund if you change or cancel travel plans is limited.
Cancellation
All cancellation requests must be sent in writing to Agency. Agency and third-party supplier cancellation charges may apply. These are typically stated in either the travel documentation, this website, or each supplier’s website. If you have any questions, or any cancellation charges are unclear, please contact your Agency representative. Cancellation charges will be charged to the credit card you authorized to pay for travel services, or in the case of a supplier refund, may be deducted from the refund.
Your Responsibility to Arrange Air Travel and Transportation to and from Home
Unless stated in writing, airline reservations are not included in your travel plans. You are responsible to arrange air travel and your transportation from home or other location where your travel originates and to your home or other location where your travel ends. Agency shall not be responsible for air or ground schedule changes.
Departure Taxes; Check-In
In some countries, on departure from the country, departure taxes must be paid in cash and may vary. You must check-in at least 2 hours before scheduled departure time for domestic flights and at least 3 before scheduled departure time for international flights. You are responsible to reconfirm flight times at least 24 hours before scheduled departure time for domestic flights, and at least 72 hours before international flights. Failure to use a reservation may result in automatic cancellation of all continuing and return flights, and forfeiture of airfares.
Early/Late Booking
You determine when to place your booking. Booking earlier reduces the risk of being unable to book due to travel being fully booked and reduces the risk of late booking fees.
No Refund for Unused Arrangements
There is no refund for any unused portion of a travel booking. Some group tours are based on minimum numbers of passengers. If the number of passengers does not meet or falls below the required minimum, a surcharge may be imposed or the tour may be canceled.
Currency Fluctuations
Currency exchange rates fluctuate. Prices are subject to change based on currency exchange rate fluctuations.
Changes to Confirmed Bookings.
We do not assure you will be able to change a confirmed booking. Changing a confirmed booking, if possible, may involve additional charges. The possibility of additional charges does not assure that a change is possible.
Health Documentation
You are responsible to obtain and have required documentation of immunizations before travel and to comply with security rules of government authorities. Agency shall not be responsible for accuracy of health requirements or vaccination and/or documentation prior to departure or on landing at any destination. Prior to travel, required inoculations must be recorded by your health care professional on a valid vaccination certificate, which you must carry for proof of inoculation where required. You are urged to also consult your health care professional regarding medications and inoculations, before booking.
Pregnancy
Each airline and cruise line has its own policy and many restrict travel or require a doctor’s note or other documentation to travel after a specified stage of pregnancy. Some airlines and cruise lines do not permit travel after a specified stage of pregnancy. Agency does not set airline or cruise line policies. You are responsible to check the policy of the airline or cruise line and to comply with their policy.

Information on health issues in some destinations may be obtained at the U.S. State Department website http://travel.state.gov, and U.S. Centers for Disease Control website http://wwwnc.cdc.gov/travel/. Information on security, safety issues, crime, requirements regarding travel documentation such as passports, visas, proof of health/vaccination certificates, health hazards and other restrictions regarding travel to some domestic and/or international destinations and re-entry to the United States is at the websites of TSA www.tsa.gov, U.S. Department of Transportation www.dot.gov, Federal Aviation Administration www.faa.gov. U.S Treasury www.ustreas.gov and U.S. Customs and Border Protection Agency www.cbp.gov. Non-USA citizens may wish to check the website of U.S. Citizenship and Immigration Services www.uscis.gov. The information in these sites is provided by the government, not by Agency. We do not represent that the information is complete or accurate.
Issuer of Passport
You are responsible to inform Agency if you are traveling on a passport from a country other than the United States.
Prohibitions and Restrictions on Hazardous Materials
U.S. law and airlines prohibit bringing hazardous materials on aircraft on your person or in luggage. Violation can result in prison and large monetary penalties. Hazardous materials include explosives, compressed gases, flammable liquids and solids, oxidizers, poisons, corrosives, radioactive materials and many other items. A few examples include paint, fireworks, flares, gasoline, gun powder, lighter fluid, liquid bleach, propane, sparklers, spray-paint and tear gas. Many other items are also prohibited. Some other items may be allowed in checked luggage but may not be carried onto the aircraft. For example, small quantities of some medicine and personal care liquids (typically limited to 3.4 ounces) may be carried in passenger luggage. You are responsible to contact the airline(s) to obtain information on airline rules and policy. Information on hazardous materials restrictions is available at websites of TSA www.tsa.gov/traveler-information/prohibited-items and the Federal Aviation Administration http://www.faa.gov/about/initiatives/hazmat_safety/.
Insecticide Notice.
International law lets airlines spray insecticide inside the cabin to protect public health, agriculture and the environment. This may involve spraying the cabin with insecticide while passengers are on board or spraying or treating inside surfaces with insecticide while passengers are not on board. Some countries require airlines to treat the cabin with insecticides while passengers are on board. You can see a list of these countries and other information about insecticide treatment of aircraft at the Department of Transportation website www.dot.gov/office-policy/aviation-policy/aircraft-disinsection-requirements.
E-Tickets.
E-tickets typically expire one year from issue date unless the carrier specifies otherwise in the passenger itinerary. There is no refund for an expired e-ticket.
Limitations of Responsibility and Disclosure.
Agency does not perform or provide your travel. Agency does not own or operate any vessel, lodging or other mode of travel. Agency acts only as booking agent for supplier cruise lines, hotels, airlines, air charters, bus companies, ground transportation, boat purveyors or owners, and other independent contractors providing accommodations, transportation, and/or other services (“suppliers”). Agency is not the source or provider of travel services. Each supplier is an independent entity with its own policies, procedures, personnel and management. Suppliers are not under Agency control. Suppliers identified in travel documentation are responsible to provide the travel services purchased.
Bookings are accepted by Agency as agent for travel suppliers. Transportation, accommodations and other services provided by the sea, ground, air and other suppliers are according to the terms in the tickets, exchange orders, vouchers, websites and other documentation issued, posted or published by them and/or their suppliers. You acknowledge that each supplier has its own terms. You consent to the use of the suppliers. You agree to the terms of each particular supplier.
LIMITATION AND DISCLAIMER OF LIABILITY
BECAUSE AGENCY ACTS AS AGENT FOR SUPPLIERS AND DOES NOT CONTROL OR HAVE THE RIGHT TO CONTROL OPERATIONS OF INDEPENDENT OPERATORS AND SUPPLIERS, YOU AGREE AGENCY IS NOT LIABLE FOR ANY PERSONAL INJURY OR PROPERTY DAMAGE OR OTHER LOSS, INJURY OR DAMAGE, WHICH MAY ARISE OUT OF THESE SERVICES. AGENCY DISCLAIMS ANY LIABILITY WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY OR OTHERWISE, INCLUDING WITHOUT LIMITATION LIABILITY FOR DIRECT, PUNITIVE, SPECIAL, CONSEQUENTIAL, INCIDENTAL OR INDIRECT DAMAGES, IN CONNECTION WITH SERVICES OR MERCHANDISE PROVIDED BY ANY SUPPLIER BOOKED THROUGH AGENCY, INCLUDING WITHOUT LIMITATION LIABILITY FOR ACTUAL OR CLAIMED ACT, ERROR, OMISSION, INJURY, LOSS, ACCIDENT, DELAY OR IRREGULARITY WHICH MAY BE INCURRED THROUGH THE FAULT, NEGLIGENCE, WILFUL ACT, OMISSION OR OTHERWISE OF A SUPPLIER, OR OF THEIR SUPPLIER OR THEIR RESPECTIVE EMPLOYEES, CONTRACTORS, AGENTS OR REPRESENTATIVES, INCLUDING, WITHOUT LIMITATION, THEIR FAILURE TO DELIVER OR THEIR PARTIAL OR INADEQUATE DELIVERY OF SERVICES AND OTHER MATTERS OUTSIDE AGENCY’S CONTROL. YOU WAIVE, RELEASE AND EXONERATE AGENCY AND YTS’S OWNERS, DIRECTORS, OFFICERS, EMPLOYEES AND CONTRACTORS FROM ANY LIABILITY WITH RESPECT TO EACH AND ALL OF THE FOREGOING.

Tour providers and service providers outside the United States may or may not comply with the ADA and other practices common in the United States. In many places outside the United States, facilities for disabled persons are limited compared to within the United States. Agency welcomes customers with special needs and disabilities and seeks to provide enjoyable, and memorable travel experiences for all customers. To assist us to do so, please note the following:
Prices
Agency seeks to honor the price originally quoted. In some circumstances prices may go up due to increase in cost for one or more travel components. Prior to full payment, prices including US air transactions or air tours (in, to, or from the U.S.) could increase for certain travel services, including: seat, baggage, fuel surcharge, or increase in government imposed tax or fee. US air transaction or air tour prices will not increase after making full payment, except for charges resulting from government-imposed taxes or fees. Some suppliers reserve the right to increase prices to cover increased costs, fuel surcharges, tariffs and taxes, and changes in currency exchange rates. You acknowledge and accept these conditions as applicable to your purchase. You authorize Agency to charge your credit card for such additional amounts. This consent applies to all travel arranged by Agency for you and your group.
Weather
We have no control over weather. Hoped for, or undesired weather conditions, including but not limited to presence or absence of snow, sunshine, wind, rain, warm, mild or cold temperatures, and all other possible weather conditions are not guaranteed to occur or not occur. Volcanic eruptions, ash clouds, wind and various other events and conditions may be characterized as adverse weather condition or natural disaster by suppliers and your travel insurance company. That is beyond Agency’s control. Agency reserves the right for itself and suppliers to adjust, modify and/or cancel any itinerary or part(s) of any itinerary as Agency or a supplier deems necessary. Agency shall not be responsible for air, water and/or ground schedule changes or other adjustments, modifications and/or cancellations.
Force Majeure
Agency shall be deemed not to be in breach of these Terms and Conditions and not to be liable to you, by reason of delay in performance, or non-performance, of any of Agency’s obligations to the extent delay or non-performance is due to any circumstance beyond Agency’s control, including, but without limitation, act of God, explosion, flood, tempest, wind, fire or accident, war or threat of war declared or undeclared, terrorism, sabotage, embargo, shortage of labor, labor strike or other labor strife, change in law or regulation, insurrection, riot, strike, civil disturbance, requisition, sickness, quarantine, government intervention, pattern of crime in an area, disease, weather condition, defect in machinery or vehicle, delay, wildlife, or other occurrence, condition or circumstance beyond Agency’s control (collectively, “Force Majeure”).
Agency or any supplier affected by Force Majeure shall be entitled to, and may in its discretion, vary, adjust, modify or cancel any itinerary or arrangement or part thereof in relation to your trip. Agency shall have no obligation to make any full or partial refund, and whether or not to voluntarily do so, despite absence of obligation, shall be at Agency’s discretion.
COVID 19
You agree that it is your personal decision to travel and that you are doing so with full knowledge of current travel recommendations and travel restrictions with regard to the risk of COVID-19, with you having taken full personal responsibility to inform yourself in relation thereto. The Agency does not assume any responsibility for and shall not be liable for any unsafe conditions or health hazards, including pandemics or other illnesses to which you may be exposed. The Agency will, however, use its reasonable endeavours to provide you with the latest travel information available to the Agency in respect of the regulations, conditions, and supplier terms applicable in relation to COVID-19, as at the time of your booking. This information is obtained from third party sources and is subject to change at any time without notice. The Agency, its employees and agents, shall, accordingly, not be liable for any loss (financial or otherwise), damage, illness, harm, trauma, death, delay, denial of onward travel or costs (including but not limited to quarantine costs), which you may incur or suffer, whether during or post travel, arising directly or indirectly out of the risks and/or dangers associated with traveling during the COVID-19 pandemic, whether or not you had been informed by the Agency of such risks and/or dangers at the time of booking.
The Agency is not responsible for the acts or omissions of travel suppliers, including the failure by the travel suppliers to adhere to their own schedules, provide services or refunds or their failure to honor any future trip credit.
Please note that most insurance policies have a specific clause stating that they do not cover epidemics and pandemics, especially when travel warnings are in place. It would be advisable for you to take advice from an insurance broker should you have any queries regarding the appropriateness of a travel insurance policy. The Agency shall not be liable for your election not to purchase insurance, nor shall the Agency be liable to you for any denial of any claim by a travel insurer as it relates to COVID-19 or any other claim under the relevant policy.
“You are aware of the risks and dangers associated with travel during the Covid-19 pandemic and you expressly assume all of the risks and dangers in relation thereto; and hereby forever release, discharge and hold the agency, it’s employees, officers, directors, associated, affiliated companies and sub-contractors harmless against an and all liability, actions, causes of action, suits, damages, claims and demands of whatsoever nature which you may now have or which may hereafter arise out of or in connection with such risks and dangers”.
Changes in Travel Plans. Changes in itinerary may be made for any number of reasons, including but not limited to weather or other Force Majeure, at the discretion of Agency and suppliers. Changes may include, but are not limited to making a reasonably comparable replacement to any property, supplier, activity or area or other aspect of the travel.
TRAVEL INSURANCE.
AGENCY MAKES AVAILABLE ACCESS TO VARIOUS OPTIONAL SERVICES AND PRODUCTS SEEKING TO ENHANCE YOUR TRAVEL EXPERIENCE AND REDUCE RISKS OF LOSS. OPTIONS SUCH AS TRAVEL INSURANCE HELP REDUCE RISKS OF LOSS OF INVESTMENT FOR SOME OR ALL OF SUCH RISKS AS SUPPLIER DEFAULT OR BANKRUPTCY, DELAY, INTERRUPTION, MISSED CONNECTION, CANCELLATION, MEDICAL EMERGENCY, EVACUATION, LOST BAGGAGE & PERSONAL EFFECTS, ILLNESS, JOB LOSS, CHANGE OF PLANS, ACCIDENTAL DEATH AND DISABILITY, TRAVEL ACCIDENT OR SICKNESS, AND MEDICAL EXPENSES. UNLESS SPECIFICALLY NOTED, TRAVEL INSURANCE IS NOT INCLUDED IN THE PRICE OF THE ITINERARY. TRAVEL INSURANCE MAY PROVIDE SOME PROTECTION TO YOU FROM FINANCIAL LOSS IN SOME OF THE ABOVE CIRCUMSTANCES. You acknowledge there is no refund from Agency or suppliers if you cancel or interrupt your travel for any reason and, moreover, Agency’s and travel supplier cancellation charges will apply, resulting in loss of monies up to the full cost of your travel booking and related costs. Purchase of travel insurance is not required, but encouraged. Agency personnel are not qualified or authorized to answer technical questions about benefits, exclusions, and conditions of any insurance, nor evaluate adequacy of insurance. Additional charges apply for travel insurance.
LIMIT OF LIABILITY
AGENCY RECEIVES ONLY OR MAINLY COMMISSIONS AND FEES FOR TRAVEL TRANSACTIONS. YOU AGREE THAT ANY LIABILITY AND RECOVERY FROM Agency WILL BE LIMITED TO AND IN NO EVENT EXCEED COMMISSIONS AND FEES PAID BY YOU AND ACTUALLY RECEIVED BY Agency IN THE TWELVE (12) MONTHS PRIOR TO THE ACTION GIVING RISE TO THE LIABILITY.
Photos/Video
Agency reserves the right to make any use whatsoever of photos and videos that include you and/or your group, made at any event or travel activity, without compensation. You are deemed to consent to appearance of you and members of your group in the photo and/or video and use thereof by Agency. Uses may include but are not limited to brochures, invitations, books, newspapers, magazines, television, websites, videos, documentaries, and any other forms of advertising, marketing, publicity, reporting and literature. Any person desiring not to have their photo or video taken or distributed must notify Agency in writing at mltagents@aol.com, prior to the start of travel and/or prior to the making of the photograph and/or video, include a photograph of such person, and receive a written reply acknowledging the person’s request. The request is not valid unless/until Agency has replied.
